No 28 Hayway have erected a wrought iron fence

Reported in the Obstruction (Not Vegetation) category anonymously at 09:34, Mon 19 August 2019

Sent to Northamptonshire County Council 2 minutes later. ref: 1736601.

We have just enlisted the help of a boundary surveyor regarding a shared boundary. The ordinance survey map he used showed that 28 Hayway have erected a wrought iron fence on their frontage that protrudes onto the Highway. He advised that they were in adverse possession of land, it is spoiling the line of the land and there could possibly be a covenant in place that prevents enclosure. It is also restricting our ability to turn into our drive. I have photos on another device that I can add to this report.

  • This issue is known as it is part of an ongoing, and long-running, highways enforcement. Matters of highway encroachment can often take many months to resolve satisfactorily, but this issue is still being progressed.

  • Thank you for the update. It is frustrating as access into our drive is difficult, causing us to cross over to other side of road to be able to swing into our drive. They have removed a hedge that has been in situ for over 40 years so currently we have a row of stumps whilst I assume this issue is being resolved. They have partially erected a wooden fence down the boundary and we are assuming there is legislation in place to prevent them continuing this fence down to the highway.
