Foothpath adjoining our drive has eroded creating a 50 mm trip hazard

The footpath surface (tarmac) has broken up and the substrate has been eroded away. Their is now a 50 mm step from my drive down onto the path. This is presenting both a trip hazard but recently, on two occasions, the front bumper of cars have scraped on the edge of our drive as they revered off. I am responsible for the pathway? - can I get it resurfaced?
