Footpath and pavement is overgrown

Sent to Northamptonshire Highways 4 minutes later. ref: 1762967.
Footpath and pavements are overgrown with brambles and bushes. Large trees are overhanging and a trunk has been cut and branches are growing out of it. Whole row of overgrown bushes and tree may cause a problem with the wind changes and may become a hazard for large branches. Has not been cut for almost 10 year ago.

Thank you for your enquiry. Public Footpath KN6 that runs adjacent to Pagnell Court was inspected on 11-9-19. This footpath was found to be accessible for pedestrians. For your information the hedges and trees adjacent to this Public Right of Way are the responsibility of the landowner to maintain. In this instance Northamptonshire County Council is not the landowner.

I am not clear that you have understood the issue that is presenting a sever risk here. The overhanging trees have already been subject to some heavy branch fall onto the footpath - indeed, your operatives had to come and cut this to remove it. Further branches are also in poor condition and represent a risk to the public for which you have a duty of care when they are on the footpath.
Similarly, the overgrown nature of the bushes over the pavement in Pagnell Court presents a similar risk - again, an area that you are expected o ensure is safe.
Photographs of this area have been provided.
Given you believe the landowner (presumably Kier Homes) has a responsibility for this maintenance, please confirm that you will be taking this matter up with them, before an injury or fatality occurs.

A letter has been sent to the relevant landowner detailing the concerns set out in your response.
