Tarmac path outside that abuts my house has broken up and causing damp in my property

When it rains the water that runs down the path has eroded the tarmac path, we have lived at the property 2 years and it has got progressively worse. The water has eroded the mortar between the bricks and it now causes a damp smell inside my house as well as causing further water damage to the external walls of my house. All rainwater that falls and flows down Club Lane ends up running past the front of my house, this is a large amount of water which has caused significant erosion. As you can see from the photos the tarmac has broken up and damp/mould is clearly visible on the bottom two bricks where the mortar has been eroded. I understand the broken pavement to be causing the issue as the bricks and mortar further up are in significantly better condition. If left untreated the problem is only going to get worse. I have tried to rectify the issue myself and have contacted a couple of builders who have told me as this is a public footpath they can not touch it.
