Illegal Claiming of Highway Land and dangerous removal of supporting bank structure adjacent to the highway

Sent to Northamptonshire County Council 10 minutes later. ref: 2099382.

For weeks and weeks now the residents of this caravan park have been extending their site (illegally) and have knowingly extended their boundaries and physically taken Highway (Crown owned) Land with absolutely no repercussions what so ever. Today i can see that they have again extended their plot both on the boughton road into the village and also on the A43 and have built right up to the boundary of the Highway by removing essential supporting material from the make up of the supporting back which supports the adjacent cycleway and Highway. Can you please tell me if this was carried out with the consent of the Highway Authority, and if not what action is being taken to re-instate the boundaries and required support of these banks/supporting structures. You have a duty to ensure that these such actions do not occur whomever the instigator is. This would most certainly not be allow in the wider community and must not be allowed to happen here. I await your response.

  • So this was sent in on the 28th April 2020 and i am as of yet still awaiting even the courtesy of a response to say you are even looking into it. . . . . . . . Can someone please reply!

  • Good afternoon, apologies for the delay in responding. ‘The Highway Authority has been on site and inspected the excavation works that have taken place at the rear of the highway embankment. There are no immediate concerns about there being any subsidence of the highway. However, the Highway Authority does require a retaining wall to be erected at the base of the embankment and this is currently being designed. The Highway Authority are liaising with the site owners over the erection of the retaining wall.’

  • Thank you for finally responding to my enquiry. Are you now able to answer the rest of my questions? specifically around the fence that has moved and take up highway land? is this going to be enforced as it must be under highway law? or are you now setting a precedence that everyone who has a land adjacent to a highway in Northants can move their boundaries as they feel like it with zero consequences. In addition can you please confirm to me that this new structure is being paid for by the persons responsible for the damage and is inclusive of the cost of design, construction and maintenance and that if it is being constructed by the landowner that the relevant checks and sign offs will be carried out by a qualified inspector on behalf of the county?

Do you not have any KPI's or performance targets to be held accountable to!? if i do not get a response i will be left with no alternative but to raise a formal complaint via the Cheif Executive of Northamptonshire County Council and my Local MP. This just is not good enough!

  • Thank you for your further enquiry, a structural engineer is currently evaluating the fence and wall for the safety of road users and it’s structural integrity. The Broughton site has submitted a planning application to Kettering Borough Council which includes the development of the site and amendments to the embankment. As part of this planning application, Northamptonshire Highways are working with both parties to ensure a retaining wall is constructed to our specification at the sites cost.

  • Unbelievably bad responses. The fence is clearly an encroachment onto highway land, yet you cowards design a wall for them.
