Illegal Parking and obstruction to oxford close and access to residents car park/

Please note the choices of category was limited. The double yellow lines are on the road but not adhered to plus there are no signs to adhere to.

I live in Spring Gardens, which is a sheltered type accommodation for over 55 years of age. The majority are over 75 years of age and have disabilities, including dementia and mobility limitations. Since the shop on Oxford Street, opposite Spring Gardens, has had new owners, a major problem has developed, including cars reversing into our driveway, parking a car in our car park, loud music from the cars and cars parking on single yellow lines on the entrance from Oxford Street to Oxford Close, sometimes 2 to 3 cars at a time, causing restricted access into Oxford Close and our car park. It happens throughout the day and night, as the shop closes at about 10pm. When drivers have been asked not to park, they have become abusive. This is causing the residents facing onto the car park and onto Oxford Close/Street a great deal of frustration and fear. I have found that a schedule EN50 identifies that it is restricted parking on Oxford Close. Daventry Consolidation 2013 Schedule 510. No Waiting at any time. Effective 30/5/2013. Can I ask how this needs to be enforced and if it is possible to have sings put up to bring this matter to some form of conclusion.

  • Thank you for your query to Northamptonshire County Council’s Street Doctor Service with regard to parking issues in Oxford Close, Daventry. As you mention the access to Oxford Close is covered by “No waiting at anytime” restrictions (i.e. double yellow lines). The enforcement of parking restrictions is undertaken by civil Parking Enforcement Offices so we will make them aware of this issue when they are operating in the area. In the past, where there were double yellow lines these had to be accompanied by a “No parking” sign plate mounted on a post or nearby lamp column. Under changes in the signing rules these are however no longer legally required, and the double yellow line road markings are now just the requisite indication of the restriction that allows them to be enforced. With regard to non- residents parking in the car parking spaces for Spring Gardens residents, these are on private land, rather than public highway, so this would need to be taken up with the owners of Spring Gardens to arrange suitable signing to deter non-residents. I hope that this explains the situation.
