Tree causing huge problems to foundations and structyres on my property

I have been in conversation with both daventry district council and the parish council with regard to this issue for a number of years now with no assistance. The tree is only the footpath width away from my property boundary and over the years the roots have displaced my boundary wall a number of times causing it to be rebuilt ever year or so at my expense. It gas reached a point now where the foundations of the wall (and potentially my property) are being affected. The repairs to the wall this time require the foundations to be dug out and replaced and the quote has come back at around £2.5k this is not a cost I can absorb for a tree that does not belong to me and will keep causing the same issues with ongoing costs. My mother (who owns the house) has consulted her legal team and will be pursuing a claim for damage to our property in order to recover the costs for the repair of the wall, but also, will be pursuing the removal of the tree before these repairs are carried out. The wall is currently in a precarious condition and we have concerns about its safety as it borders the footpath and so this is a reasonably urgent matter. Inspecteed by area manager today and later by tree surgeon. Consensus is that the tree is in poor health and likely to become a safety issue. We will remove during the autumn. Awaiting price and risk assessment.
