Mud on road
Reported via desktop in the Mud on Road category anonymously at 12:36, Wed 25 November 2020
Sent to Northamptonshire Highways less than a minute later. ref: 2404796.
On the main rd between holcot and hannington there is a lot of mud on the road - more towards the holcolt end. This appears to be coming from the farm transporting soil. I skid this morning.

More mud on the road today - courtesy of the farm. My car looks like I’ve gone off road across a field. It’s not on. This is supposed to be a public highway, not an extension of the farmers land that he can do what the hell he likes with.

Thank you NCC for doing this but... 1. It shouldn't be down to you to have to do it and pay for it. 2. It will happen again, its an ongoing issue.
What can be done...?

This is a ridiculous situation and somebody is going to be seriously hurt or killed! Today it started raining and the whole road turned into a rally track. Cleaning the road will not solve this problem because the farmer is doing it everyday to an industrial level!
Please resolve this before there is a serious accident. I won’t even mention the state of our cars!!

To clarify. We live an area of agriculture. The farmers fetch and carry from fields to barns or sheds. They leave field deposits on the roads. They should consider other road users and make good their pollution. They don’t and nobody seems to care. The HAN to HOL road was so bad today I decided to come back via Walgrave. The mud trail came from a large field on the right going up the hill from the junction. In the past this has been a route for ‘muck spreaders’ through HAN village with stinking animal / straw droppings. So far not much this year. The other type of pollution is from the sheds on the HAN HOL road just this side of the junction. Previously there was livestock being housed there. There is no cattle grid between that group of sheds and the road. That means an egress of water born detritus that could be soil and animal products onto the road and down the hill. I cleaned my car the other day with a pressure hose and minimum physical contact. The smell was awful and the deposits sticky. So! Sticky and smelly deposits. There is therefore a choice of sources for the pollution. Is it from the sheds on the HAN HOL road or the muck covered field on the HOL WAL road. If on the HAN HOL shed land, then a cattle grid with a pit that overflows onto the land and not the road. Could that be solution to be undertaken by the shed owner. The other source needs to be logged and reported as pollution.

The mud being deposited by the farmer on this road and the one then going from holcot to Walgrave is in breach of the Highways Act. Section 149 i think where it states if it is a nuisanceor dangerous, which it is both. It is therefore an offence and his responsibility to prevent it or clear it up. It is almost every day. The road was a rally track again last night. Unfit to be used asa highway. NCC, this is urgent and if you don't sort it, you will potentially be responsible for someone being in an accident, you have been advised many times now.

A number of people have complained about this issue. Dangerous amounts of mud are still left on the road on an almost day-to-day basis. It's been pointed out that there is a legal responsibility on you to keep highways safe. This road is clearly not that. What is being done to resolve this please - can you update us?

More chunks of wet mud on the road from a field further up towards Hannington all of the way down to the farm entrance and beyond (towards Holcot).
Is anything being done about this NCC..? It's all gone quiet at your end of things.

Once again, huge quantities of mud being spread across the road for long distances in between Holcot and Walgrave. This is in breach of the Highways Act. Section 149. It is both a nuisance and very dangerous. I believe it is an an offence and the farmer needs to take responsibility for the appalling mess he is creating on a daily basis over a period of many weeks. This is not nee either as it was happening last year! When are the council going to take action with regard to this blatant disregard for the road users in this are!? up. It is almost every day. The road is not fit to be used as highway abs the situation needs to addressed robustly before there is a very serious accident!

It does not require a PhD to work out who posted the last message in relation to this issue. The behaviour of this landowner is disgusting with no consideration whatsoever for other members of the community. The road will clear intermittently but then go back to its usual dangerous and nuisance condition. It needs to be monitored over weeks, not just through a solitary visit to site.
I will be discussing this matter with our local MP and the media.

Well if it doesn't stay in a decent and reasonable state as it should, the issue will just be raised again - so landowner (if it is you) take note. We've all had enough of it.

I wrote to the highways people, who say they have found it difficult to talk to the land owner, so are planning on taking enforcement action!! At long last... I guess we will have to wait and see. I walked the road on Sunday 10th January, it was a real mess, thick with mud and as vehicles passed us we were sprayed with mud and peppered with small bits of grit. Is the landowner on the parish Council by any chance?? On Google maps it says their name on the farm location... that might explain the lack of action!!

There is also an 8 wheel tipper truck from what looks like Maccolls Engineering... using a muddy lane on the opposite side to the Farm, about 300 yards toward Hannington. It is in and out of there even on Sundays... again depositing mud and chewing up the grass embankment opposite the entrance to the field... on Google maps it looks like there is a storage facility down there, maybe connected to the farm??
