Overgrowing/hanging tree

Sent to Northamptonshire Highways less than a minute later. ref: 2795892.
A huge sycamore tree hangs over our boundary and causes real problems with leaves dropping and more recently, sticky sap dropping all over patio and stones laid only 2 years ago and as you will see from the photos - it is ruining them. Pieces of branch break and fall down (luckily not on top of our young children yet) and prior to our new patio being fitted, the roots of the tree had lifted & damaged the old patio. We believe the tree need to be cut back/pollarded which I don't believe it has been in the 7 years we have lived here. Our parish councillor did raise the issue of this tree under job ref 268612 as both we and our neighbours at 24 are having issues and are also worried about the safety of the tree, which also hangs over the public highway (The Lane) behind us. The previous job ref was closed on the basis there was deemed to be no safety issues but I do not feel that is a satisfactory response and would like to understand when work will be planned in to remedy this problem.

Thank you for your enquiry and for bringing this matter to our attention. We understand that you have concerns about the condition of the vegetation on the pathways adjacent to The Lane; specifically a tree you feel it is overgrown, restricts accessibility of the footpath and poses a safety risk to pedestrians. We appreciate your concerns and can confirm the growth of the vegetation is programmed to be cut back, in the next six months, under our maintenance programme; however, work is usually being carried out well within this time. Thank you for your patience and understanding.

Thank you for your reply. It is reassuring to know this is now planned in to take place very soon. Please can you confirm, as it’s not clear from the reply, that this will include the parts of the tree that overhand our land (and our neighbours) and the plan is not purely to undertake tree trimming activity on the side that overhangs The Lane. The concern I’ve raised is specifically relating to the overhanging of ours (and our neighbours properties). Thank you

Thank you for your further comments. We confirm that we are undertaking a reduction on the Sycamore, which includes some branches overhanging into the garden of the 2 properties to keep the tree in balance. These tree works have been identified in our tree report. However, under the general rule of thumb, where tree branches spread over an adjacent property, a common law exists for the owner of that property to prune back the offending branches to the boundary of that property. With regard to the report of leaves and sap that fall from this highway tree, West Northamptonshire Council cannot be held responsible for, and will not take action to prevent the fall of leaves, berries or sap on to adjacent land or property.
