Hello We had a tree surgeon visit our property at the weekend to look at a couple of trees within the demise of our property. He noticed a large tree forming part of the verge of the highway adjacent to our land that may be potentially hazardous. We have reported this to West Northants Council however they have suggested it is our land and asked us to check with the Land Registry. Fortunately I work at a law firm so I could do this online and it is clear from the LR records that the verge forms part of the highway. Furthermore my Real Estate colleagues said it would be highly unusual for that not to be the case due to highways departments wanting the ability to keep line of sight clear. Also the road in question was the A43 and therefore the highway existed a long time before the development and the land acquired by the developer did not, for obvious reasons, include the highway. Could you please arrange for somebody to look at it and assess if any action is necessary. The highways team will need to be involved as, if the tree does need to be felled, it will almost certainly require closure of the highway. Thank you. Ian Mabbutt
