MORE PHOTOS AVAILABLE I am disappointed to have twice received correspondence from the council denying responsibility for the tree, the first from your inspector using the word “assume” and the other from yourselves stating “in all probability” , In my world such phrases mean actually we don’t know, I am therefore sending you hard evidence as requested. Adjacent to number 5 and 7 the original concrete fence post defining the end of the garden remains. Adjacent to number 5 and 3 the original concrete fence post defining the end of the garden remains. Between these posts there is a concrete strip running the full width of number 5 defining where the garden ends and were the council owned verge beings, I have taken several photos showing this strip, in particular please look at the picture also showing the steps across the verge, these steps belong to the council and have in the past been maintained by the council, please note the bottom step is the edge of the verge. The verge extends from the concrete strip up to the path, the tree is on the verge as are the steps, the council regularly maintain the verge. The last photos shows the original picket fence post adjacent to no5 and 7 deliberately left in place as a boundary marker, as you can see the tree is well to the right of the post and concrete strip proving beyond doubt that it on the council owned verge, I have also included a copy of your own map showing the tree to be yours, I also have an email from the council confirming the same I put it to you that my evidence is fact not assumption, could you therefore make arrangements for the tree to be removed asap.
